ONPTL.com is the Ontario Tournament Poker League website. To become an ONPTL.com member, you have to be at least 18 years old and fill out the mandatory fields in the registration form.

ONPTL.com allows you to register to become an ONPTL.com member and receive a player’s card which will allow you to participate in tournaments organized in various venues throughout the province of Ontario. This privilege involves respecting certain obligations. The member commits himself to attentively read the Terms of use outlined below and to fully understand their reach before consenting to them.

By becoming a member of ONPTL.com, you pledge to respect the Terms of use. If you do not accept those Terms, you should not register with ONPTL.com. By checking the box “I have read and agree to the Terms of use of ONPTL.com” located at the bottom of the registration page and by validating it, the member recognizes that he/she is bound by the Terms of use provisions. By accepting to use the services provided by ONPTL.com, the member consents to respect the Terms described further as well as the rules and any and all subsequent modifications to them.

Please note that ONPTL.com reserves the right to modify or amend, at any time, the web pages of www.ONPTL.com, the services offered, the promotions offered or their Terms of use. These modifications will take effect as soon as they are posted on www.ONPTL.com, without prejudice for all members to terminate their subscription to ONPTL.com. The member shall be known to have accepted the modifications by his continued use of the www.ONPTL.com website or its services. All new characteristics that improves or increases the existing level of service or any new service launched by ONPTL.com shall be submitted to the present Terms of use.

Access and registration to ONPTL.com

To use the services of ONPTL.com, you need internet access. The charges thereby incurred are at the sole responsibility of the member. Furthermore, the member must take care of any material necessary, in particular a computer, a modem or any other connection tool, to assure his own internet connection. The equipment (computer, software, means of telecommunication, etc.) allowing access to the services is the sole responsibility of the member, as well as any telecommunication charges incurred by their use.

In no case will ONPTL.com be held responsible for the loss of this information by the member.

In a case where a member would give out or use these elements in an adverse way, ONPTL.com reserves the right to terminate the member’s account without notice.

The member is the sole responsible for the use of these identifying elements by a third party or by actions or declarations made by way of his account, whether they are fraudulent or not. He exonerates ONPTL.com against any requests made this way. In addition, ONPTL.com not having the means necessary to verify the identity of persons registering for its services, ONPTL.com is not responsible for identity theft. If a member suspects that his identity has been stolen, he must inform ONPTL.com immediately.

Member’s obligations

As part of the services’ use, the member commits to respect the following rules:

• Abide to laws in place and respect third party’s rights.
• Abide to established rules.
• Not use ONPTL.com for professional or commercial gain.

In case of a breach of trust by the member to one or more of these rules, ONPTL.com reserves the right to block his access to all or parts of the services, in a temporary or definitive manner.

Guarantee exclusions

ONPTL.com makes no commitment as to the relevancy of all or part of its website’s content. The entire site’s content is provided “as is” and, so far as possible by the applicable law; ONPTL.com expressly excludes any guarantee, even inherent, for the marketable quality, or for any particular usage adequacy.

The ONPTL reserves the right to remove without notice all pictures deemed offensive, inappropriate or which violates copyright laws. The picture gallery is available to venue owners so that they can promote their respective establishment, special events as well as poker in general. Any abusive usage, outside the scope previously defined, will be sanctionned, notably by the immediate removal of the service for the user at fault and up to a definite expulsion from the League. The ONPTL reserves the right to use the images submitted through this service in its promotional and informational tools, such as magazines and Web sites. By submitting images through this service, you agree to these conditions.

Sending e-mails

An email system has been made available to tournament directors for the purpose of regularly informing the players who attend games in their establishment of the current activities and promotions going on. The use of this system must be done exclusively for ONPTL activities. Any abuse of the system or usage to promote products or other events not relevant to the ONPTL will be penalized, notably by the immediate withdrawal of this service for the user at fault and up to a definitive expulsion from the league.

Information sharing

ONPTL.com and its partners are susceptible to send you promotional offers, unless you are opposed to it by not checking the appropriate checkboxes. If you prefer not to receive the offers selected for you by ONPTL.com and its partners, you can inform ONPTL.com by email at .

ONPTL.com can sometimes share non nominative general socio-demographic information with selected partners to allow them to target their advertisement (by age category, sex, revenue, etc.). In these cases, we do not give them any personally identifiable information.

Without prejudice to other existing provisions, in case of a breach of trust by the member to these Terms of use, ONPTL.com reserves the right to suspend or terminate the member’s account without warning or reimbursement (if necessary) and/or engage in legal pursuits against him.

This termination will intervene in its full rights and without prejudice of all damages and interests that could be claimed by ONPTL.com in restitution of prejudice sustained by those breaches.

The member will be informed by email of his termination or of the termination confirmation of his account. Data relative to the member will be destroyed following his asking or after an expiration delay of 6 months following the termination of the account.

The member recognizes that ONPTL.com cannot be held as responsible in his regard or a third party’s for any termination of his access to the service.

Security and efficiency of ONPTL.com

Information gathered about the member upon registering with ONPTL.com is used to offer the best services possible. All precautions were taken to store the information securely in our databases. Information gathered is protected as much online as it is offline. Only certain employees have access to that information, accessible only in case of need.

ONPTL.com does not guarantee effectiveness without fail, nor a total security solution. It is possible that an unauthorized individual succeeds in accessing information on the server. Gestion Poker Tour cannot be held responsible, in any way, for any loss or damage resulting from the use or lack thereof of all or part of the content, information, software, services or other content on ONPTL.com, whatever the reason, even if ONPTL.com was advised that such loss or damage could occur. In this case, only the member must consequently assume the cost of any service, restitution or correction that results.

If some laws in Canada do not apply to the member because of his country, state, province, region, city of origin or any other reason, the member nonetheless accepts to conform to them, without reconsideration whatsoever.

No advice and no information, either oral or written, obtained by members of ONPTL.com or by use of its services, are susceptible to create guarantees in which the member could benefit, other than those intended in the existing Terms of use.

Limitation of responsibility

The member recognizes and accepts that, in all extent of the rules in place, ONPTL.com cannot be held responsible for any damage, direct or indirect (and this, even if ONPTL.com was informed of the possibility of such damage) that could arise from:

1. the use of or, to the contrary, the impossibility to use the service of ONPTL.com;
2. the cost that could arise from using the services of ONPTL.com;
3. an unauthorized access to the service by a user or to the modification of his personal information;

Failing to exercise the rights that have been recognized in this document does not constitute a relinquishment by ONPTL.com to have its rights enforced. In the assumption that one of the provisions in place by the existing Terms of use be declared null by a court decision, the parties concede to guide the judge so that his/her assessment takes into account the intent of the parties brought on by these existing Terms of use, while the other provisions keep their validity and are still applied between the parties.

The existing Terms of use and the relationship between ONPTL.com and its members are subject to Ontario and Canadian law and any disagreement for which no acceptable outcome has been found will be filed with the judiciary district of Montreal.

It is strictly forbidden to reproduce, copy, sell, resell or exploit for commercial gain of any kind, any part of the services, any use of the services or any access rights to the ONPTL.com service.

The brand names, logos, domain names, graphical elements, pictures and text contained on ONPTL.com’s website are the intellectual property of GESTION POKER TOUR and cannot be reproduced, used or represented without the express authorization of Gestion Poker Tour, under penalty of prosecution.

The usage rights conceded by ONPTL.com to the member are strictly limited to the access and the use of the site’s functionality for private and personal use for the duration of the member’s membership to ONPTL.com. Any other use by the member is strictly forbidden without the authorization of ONPTL.com.

The member is not permitted to modify, copy, reproduce, download, broadcast, transmit, commercially exploit and/or distribute by any means necessary the services, web pages of ONPTL.com, or the underlying computer source code of the elements which make up the services and www.ONPTL.com website.

The member acknowledges and accepts that the service and any software used in relation to the service might contain confidential information and is protected by the Intellectual property law in place or any other law. The member also acknowledges that he is aware that the content included in sponsored advertisements, information that are presented via the service or by advertisers are protected by Copyright laws, Trademark laws, Patent laws or any other laws recognized by the current legislation. Except where expressly authorized by ONPTL.com or the advertiser, the member pledges not to modify, rent, borrow, sell, distribute or create spin-off work based on all or part of the service or software.

ONPTL.com grants the member, in a personal capacity, the non-exclusive and non-transferable right to use the service offered; although noting that the member is forbidden to (and that the member cannot grant someone else the authorization to) copy, modify, create spin-off work, reverse engineer or disassemble by any means to find the source code (with the exception of cases allowed by the law), sell, award, sub-license or transfer by any means any rights pertaining to the service.

The member commits to not modify in any way or to not use a modified version of ONPTL.com and notably (without this enumeration being limiting) to gain unauthorized access to the service.

The member accepts to not access the service by other means than the interface provided by ONPTL.com.
